ESEA NEGOTIATIONS 2009 ESEA has had several kinds of bargains with negotiations. The RIF changed the usual contract negotiations as Members know them to be. · Because CCSD failed to bargain with ESEA over the impact that complete elimination of the Permanent Sub Teacher position as well as elimination of Food Service Workers would have on the employees, we filed an Unfair Labor Practice. Also, ESEA asserted that CCSD did not follow Article 25 nor the language in NRS 288.These allegations ultimately led the parties to the Mediated Settlement Agreement, as well as the RIF Challenge Procedure. Both of these documents are FIRSTS FOR ESPs IN NEVADA. ESPs could challenge their placement as well as other things about their RIF-ing. These are to stay in place for future situations to come. Our intention is for these documents to become part of Article 25. The above situations constitute basis for two of our types of bargaining going on at this time: 1-Impact bargaining over the elimination of all the PST positions 2-Impact bargaining over the elimination of 4.1 Food Service Worker positions · On June 23, 2009, ESEA and CCSD Bargaining Teams met for Session 1 of overall negotiations. ESEA declared that we wanted to go for traditional bargaining due to trust issues around the RIF. CCSD presented its proposal that did not include the payment of the PERS contribution increase passed by the 2009 Legislature. CCSD said they “had no appetite to cover the increase in the PERS contribution. ESEA said that we would not accept the proposal without the payment of the PERS contribution increase. The parties set this as session1 and the meeting was dismissed. We will return to this overall contract bargaining soon. ESEA has since filed a grievance now going to Arbitration over the salary cut passed on to employees to cover the PERS contribution increase. The Arbitration hearing will be held on January 22, 2010. · ESEA Bargaining Committee has been meeting to discuss the Rewriting of Article 25 and we will soon be setting meetings with CCSD to get that underway. This is another type of bargaining. ESEA is poised and ready to continue with all the previously named types of bargaining going on with ESEA and CCSD. The parties have the Federal Mediation and Conciliation Services present during all negotiations.

ESEA Teams are back at the table on February 9, 2010, for session 4 for the PSTs as well as session 4 for the Food Service Workers.
